Placing A Value On Your Personal Injury Claim

By Daniel Baldyga Your Medical Doctor or Chiropractor has released you from treatment for your motor vehicle accident and enough time has passed so youre about to position yourself to sit down with Adjuster Henry Hard-Nose. His employer is Rock Solid Insurance, the company who insures Fred Fuddle, the individual who plowed into your rear end, smashing you with a tremendous crash which was responsible for your injuries plus the Pain and Suffering youve had to endure. To be adequately compensated for what youve gone through you must have accumulated whats identified in the world of insurance claims as Special Damages. Those are your Medical bills, your Lost Wages plus every dollar paid out to help with your recovery. When building the value of a personal injury claim there are several key elements you should be aware of: LIABILITY: In the vast majority of motor vehicle accidents its clear who was at fault. Assuming that Fuddle struck you a mighty blow in the rear end (rear-enders make up well over half of the motor vehicle accidents that take place in the United States each year) yours is a case that must be settled. TYPE OF INJURY: If there are severe injuries (which make up only ten to fifteen percent of all motor vehicle accidents) you should obtain the services of a lawyer. But, if youve had minor injuries like whiplash, bumps, bruises, sprains and/or strains (and it’s clear you’re not at fault) you can handle and settle the claim yourself. TYPE OF PERSON YOU ARE: Rate yourself and be brutally honest. Youre most likely an average motor vehicle owner/driver, living a normal life. But, if the entity that hit you was a dilapidated junk pile on wheels operated by Fred Goof-Ball Fuddle, and the named insured is The Fuddle Rotted Cow Manure Corporation, that will obviously not be favorable for Rock Solid. DAMAGES: There are Medical Special Damage Expenses, Non-Medical Special Damages Expenses, and/or your Property Damage Expenses. MEDICAL SPECIAL DAMAGE EXPENSES: These typically include Cost of Ambulance, Emergency Room, Hospital and/or Clinic Charges, Chiropractor, and/or Dentist, Over-The-Counter Drugs and/or Prescription Medications, Laboratory Fees and Services, Diagnostic Tests: X-Rays and (CT) Scan, Prosthetic Appliances or Surgical Apparatus, (Cranes & Crutches), Physical Therapy, Registered and/or Practical Nurse Fees, Ace Bandages, Gauze and Tape, Heating Pads, Creams, Lotions, Ointments, Balms and Salves. When it comes to listing your Medical Special Damage expenses dont overlook one single dollar because, when it comes time to settle your claim, that dollar can increase the value of your payment for Pain and Suffering by a multiplier of four or even five! (Yes, that means a $20.00 bill can be worth $80.00 to $100.00 more ,in your pocket, from Rock Solid Insurance, at settlement time). NON-MEDICAL SPECIAL DAMAGES: These typically include Lost Wages and Earnings, Lost Vacation time and/or Sick Leave, Travel Expenses (car rentals, public transportation, expenses incurred getting to and from your Chiropractor and/or hospital and/or physical therapy treatment of some sort) Household Help during disability and/or Child Care. Be sure to obtain written proof of such “Non Medical” Special Damages. LOST WAGES: The income you lost, because you were unable to work, is an area where adjusters take terrible advantage of the typical claimant because they know so little about it. Or, if youre self-employed, get this information stated on your accountants letterhead. The time you miss from work (thus the money you may have lost) is calculated and this element constitutes what is known as Lost Wages or Lost Time Verification. In most situations youre entitled to compensation for lost time and earnings, even if you have no actual loss of money! Such as, for example, when your salary is paid by your company insurance coverage, or by taking sick leave, or some similar arrangement. Even if youre salaried you should obtain a “Lost Earnings”, or “Time Lost Verification”, in writing on your employers letterhead. IF YOURE SELF-EMPLOYED: To prove your lost earnings youll probably have to assemble some inside information for Hard-Nose. If you dont like the idea of submitting private documents to him, in the privacy of your home or office, just think how youd feel about producing them in the non-private environment of a courtroom. When a case goes to trial, and if you want to prove your damages so as to collect adequate compensation, thats your only alternative. TWO CRITICAL AREAS REGARDING LOST WAGES: Did the injury necessitate a change of job or employment at a lesser rate? Or, did the injury allow your going to work but only on a part-time basis? If the answer to either question is Yes, it would be wise to ask your employer to document these facts on their letterhead. ITS CRUCIAL FOR YOU TO KNOW: Even if youve been paid while out of work, you can still compute your time lost from work as Lost Wages . PROPERTY DAMAGE EXPENSES: These typically include Motor Vehicle Repair, Damaged Clothing, Broken Glasses, cost of Substitute Car Rentals, Towing and Storage. Make copies of all bills relating to any of your property damage expenses. Keep the originals. Be sure to have these in your possession when you and Hard-Nose plunk yourselves down to “Talk Turkey”. Photocopies are sufficient to give him. YOUR AGE: Because of their obvious innocence, insurance claim accident victims, up to the age of 12, generally have excellent settlement results. Those in their teens, and into their late 50s, fall into a fairly normal category because theyre generally considered to be at the height of their physical stamina. Those in their late 60s, and over, usually fare extremely well; primarily due to the sympathy thats often invoked, from a judge or jury, because of general attitudes regarding frailty and the elderly. MOST IMPORTANT TO REMEMBER:The information Hard-Nose places into your file plays a major role in the ultimate value of your claim. Never underestimate the importance of his impressions and conclusions! Should, one day, your case ends up in front of a judge, or jury, what Hard-Nose feels, observes and then reports into your file at Rock Solid about you, his insured Fred Fuddle, and/or possible witnesses, etc., (in addition to the information youve documented for him) could have massive influence on the value of your claim - - especially if Fuddle is a loser and hes absolutely in the wrong. Labeling a Student

By Linda Weaver Clarke Teachers have a great responsibility. They are not only teaching young minds, but they are shaping the future. Who knows if just one student in their class might become the next senator or a George Gershwin who was the king of jazz, men who made life a little better for all of us? The sad thing is that some teachers dont seem to take the time to understand their students and help them to learn, just because some of the children may be difficult. A young fifteen-year-old boy received excellent grades, but his teacher didnt understand him and was not willing to, either. The teacher felt the young man was disturbing the class and was a troublemaker. Because the teacher was not interested in getting to know his student, he demanded the boy leave school because his presence disturbed the other students. Albert Einstein, a great physicist, quit school because of a teacher. I was told about a young classmate whom the teacher had labeled dummy, simply because he was slow. The students soon picked up on it and the boy lived with this label until he left school. He didnt really try hard to get good grades because of the stigma that was placed upon him. How would he have turned out if the teacher had labeled him something positive? What if he was labeled as one who really tries, one who can create with his hands, or one who is kind to others? This student might have grown up with a better attitude toward school, wanting to excel in life. He may have become an asset to the community if it werent for someone demeaning his character. Teachers should not label their students and degrade them in front of their peers. Once he or she is labeled, its a stigma that stays with him until something changes. Name-calling, labeling, and demeaning only hold a student back from a greater future. In my novel, Melinda and the Wild West, I included one of my own experiences as a substitute teacher in which an eight-year-old student had been labeled as a troublemaker by her teacher. The students had listened to the teacher and steered away from her, not wanting to be her friend. This not only made her feel degraded, but she wanted to fight back and she did. She stopped doing schoolwork, refused to be part of the class, and got into a few fights. She seemed angry at the world but after working with her for a while, I soon learned what a sweet and wonderful child she was. She had characteristics that I was impressed with. When she realized that I really cared, she was willing to do her work, just to please me. When I wrote a note to her mother, telling her what a wonderful child she was, her mother came to me with tears in her eyes as she tried to express her gratitude for this little scribbled note. In turn, I tried to control the tears that stung my eyes, not wanting to show my emotions. Ill never know how this young girls life turned out, but in my novel I chose a happily-ever-after ending, just because a new teacher cared and made a difference in the girls life. I wonder how many teachers have made a difference in a students life simply because they cared? Long ago, I remember a Student Teachers praise that taught me to love English. This teacher made a difference in my life, simply because she cared. Teachers should be the first to praise a students efforts and show they really care. I hope all teachers realize they are in a position to make a difference in someones life. Men’s Wedding Rings - Should a Man Wear One or Not?

By Peter Crump Strange as it may seem the use of a wedding ring by men was not common until recently. Whereas women have worn wedding rings for eons, men have not. The use of rings as a symbol of everlasting love enshrined in marriage can be traced back thousands of years. But not so much for men. It was, in fact, during the second world war that the use of wedding rings by men became more common. (Note that mens wedding rings and mens wedding bands are interchangeable, both meaning the same thing.) It became the custom for US soldiers going to war to publicise their marital status by the wearing of a mans wedding ring. They were happy to make public their commitment to their wife by the wearing of a public symbol that declared that commitment to all. Given that this habit of wearing mens wedding bands was reasonably new it was all the more creditable that these men were willing to forego the marital obscurity available to them from not wearing a ring and actively chose to make a public statement about their choice. Mens wedding rings have become increasingly more common since that time. Today it is probably as common for a newly married man to wear a ring as not. This may be due to several factors. The modern man may consider it his duty to choose to make the same public marital statement as his wife will. And his wife may well consider it a condition of the marriage that he do so. After all, in these days of equality, if she is prepared to make a statement then should he not do so as well? Despite the fact that the wearing of a ring by a woman is a matter of choice, it is in fact almost obligatory due to the fact that it is so common. Many women do not even consider the possibility of not wearing one. Often, however, a man usually considers the wearing of a man wedding ring very carefully. There are a number of issues to consider. Firstly, is he concerned about a public display of his marital status? Some men, whether rightly or wrongly, are threatened by this. Others are not in the least concerned. Secondly whilst the wearing of jewellery by women is so common as to go unremarked that is not necessarily the case for men. For many men the wearing of mens wedding bands is just a case of being asked to wear jewellery. Men often do not feel comfortable wearing jewellery and in many cases have never done so before. Whilst some men see their wedding band as different to wearing ordinary jewellery, others feel just the same as if they were being asked to wear ear rings. Its just not done by men. The author, for example, wears a man wedding band, but would never consider wearing any other form of jewellery. And as many men have never worn any form of jewellery before they have no idea what it will feel like to have something permanently on the finger. Is it heavy? Does it rub? Silly as it may seem to women this can be of concern to some men. (If this genuinely is of concern it is quite possible to find a cheap jewellery shop, buy the cheapest ring available and wear it for a while. See exactly what it feels like. And find out your size at the same time.) Mens wedding rings are, in the eyes of some men, effeminate. Real men dont wear rings or jewellery at all. This is becoming less of an issue as the wearing of a mans wedding ring becomes more common, but is still an issue with many men. Culture is also a consideration. In many cultures the wearing of wedding rings by men would never be considered. Men must think about how their particular culture, and also their religion, would view the wearing of a wedding band. There are also practical considerations. Many men are engaged in trades where the wearing of a man wedding band would be downright dangerous. Although unlikely it is quite possible for a ring to get caught in machinery. In some jobs a ring cannot be worn on the job, and must be removed. This can also apply to women. Ultimately though, the wearing of a mens ring is just one of the many choices the man will have to make once he makes the commitment to marry. And it is often a choice made by the couple together, maybe one of the first they make in conjunction about their wedding. Which finger is the ring worn on, and why?Generally a mans wedding band is worn on the ring finger, the same as for women. The ring finger, for those unmarried men not familiar with the concept, is the fourth finger of the left hand. This is considered to be the finger closest to the heart. This notion came originally from the ancient Greeks who believed that this finger had an artery which flowed straight to the heart. Whilst anatomically incorrect this makes for good fable. So you have both decided that he will wear a mens wedding ring!Once the man or couple have made the decision to purchase a mens wedding ring for him there are still choices to make. Do they want to wear a matching set? Or does he prefer that his ring looks quite different to his wifes. It is perfectly possible for a couple to buy a ring set where the style of the rings match perfectly, or even with matching engraved messages of love. Generally though, even where the couple are to wear a matching ring set, the two rings are different. It is more common for the mans wedding ring to be wider than the womans. This is because mens hands and womens hands are different. A woman usually has narrower finer fingers, and so a narrower band suits her hand. A man on the other hand has wider chunkier fingers and so a wider man wedding band is more suited. This often results in the mans ring costing more than the womans ring even with matching styles, as the mans ring uses more, often expensive, material. There are many innovative styles available now. Many men prefer a simple unadorned band, however others enjoy highly decorated styles which make a loud statement. The wearing of, for example, very wide and highly adorned Celtic rings is becoming much more common. When considering the styles of mens wedding rings it is well worth thinking about the personality of the individual. While different men have very different personalities different rings will suit different personalities as well. A loud outgoing man, for example, can wear a loud outgoing unique mens ring. There are many different ring materials which also reflect the personality of the individual. Titanium or Platinum are both becoming much more popular. Whilst diamonds are not, of course, as popular with men as with women, they do make a clear statement which pleases some men who choose them. Diamond mens rings clearly say I can afford it or at least the big ones do. But it can be a brave man who chooses to wear a large diamond band. Ultimately there are no rules about choosing a man wedding band. It is up to either the man or the couple together to make a decision. Will he or wont he. There are a variety of considerations. First, will he wear one? Once that decision is made in the affirmative then there is a whole world of choice about styles, widths, materials and the type of statement the ring makes, both for the man and the woman. But once he has his ring on it is rare that he decides that he doesnt like it. And even if he doesnt, it is rare that the woman will let him take it off! He picks his restaurant favorite restaurant- that only serves your least favorite type of food. You then are either forced to eat food you hate, or take the risk of frustrating your date by asking him to take you somewhere else. Either way, it definitely can put a damper on the evening! Although you both planned on eating, you had a different vision of what food you would like. You can take this analogy and apply it to relationships in general. Whenever two people enter into a relationship, they both have an idea of where theyd like it to go. However, their vision of the relationship can be as varied as the restaurant industry! It is very important to know what your partners vision is: about your relationship and about life in general. Does he desire to settle down in a monogamous relationship for the rest of his life, or does he want to have a noncommittal relationship just for now? What about you? What do you envision in your ideal relationship? It makes all the difference to know that you both are seeking the same thing, or you will end up miserable. Weve all seen it before, perhaps without realizing it. You really love him, and want to spend the rest of your life together. He seems to love you too, but is allusive. Finally, after months, or sometimes years of heartache, you realize hes never going to change. His vision is different than yours, and nothing you can do can change that. Only he can. Save yourself some heartache, and be sure to check your vision and his for compatibility. Another important part to look at is your lifes vision vs. his. Do you plan to settle down in the town you grew up your whole life, while he wants to work in the international arena and travel through out the world? This would lead to some obvious conflict down the road. Other more subtle examples would be the role children play in each of your lifes visions, what kind of lifestyle you plan on leading, what your dreams are, and so forth. In a nutshell, your vision is where you plan on going and what you plan on doing in life. It is ridiculous to think that you can get to two different places at the same time in one car. It is just as important that you have compatible vision in your relationships. Take time to know your vision so that you end up happily together with someone instead of torn as you both try to go in opposite directions together.
